AGREEMENT BETWEEN USER AND ESCAPE COMMUNICATIONS ENTERPRISE
The network of ESCAPE COMMUNICATIONS ENTERPRISE operated by SCOPE ADVERTISING & PUBLISHING or its affiliates or subsidiaries, is comprised of various Web sites and Web pages. The services provided are offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein. Your use of the Wonder Secretary Web Site constitutes your agreement to all such terms, conditions, and notices. Your use of a particular ESCAPE COMMUNICATIONS ENTERPRISE website included within the SCOPE ADVERTISING & PUBLISHING Web Sites network may also be subject to additional terms outlined elsewhere on that website (the "Additional Terms"). Additionally, the Wonder Secretary Web Site may themselves contain additional terms that govern particular features or offers (for example, sweepstakes or chat areas). In the event that any of the terms, conditions, and notices contained herein conflict with the Additional Terms or other terms and guidelines contained within any particular SCOPE ADVERTISING & PUBLISHING website, then these terms shall control.
By accessing or using this Site, you agree to these terms of use, conditions and all applicable laws. If you do not agree to these terms you may not use this Site.
ESCAPE COMMUNICATIONS ENTERPRISE reserves the right to change the terms, conditions, and notices under which the ESCAPE COMMUNICATIONS ENTERPRISE Web Sites are offered, including but not limited to the charges associated with the use of the ESCAPE COMMUNICATIONS ENTERPRISE Web Sites. You are responsible for regularly reviewing these terms and conditions.
Billing is to occur on a monthly basis starting the day of the acceptance of this agreement. In the event that a customer provided credit card ceases to be valid the customer will be informed and failure of customer to update his billing information within a grace period of seven(7) day period shall constitute a default by customer. ESCAPE COMMUNICATIONS ENTERPRISE mayelect to suspend and/or discontinue the use of This Site and its services without further notice.
In the event that Customer believes there is an error in their billing statement, a credit is due to their account, and/or maintains any other concern, Customer must make a written request to the billing department at billing@wondersecretary.com. Such request may occur no later than 45 days after the date following the date of the challenged invoice, otherwise Customer relinquishes the right to any credit.
Any dispute, claim or controversy which may arise in the connection with these Terms shall be interpreted pursuant to laws of the State of Florida and shall be brought in a Court of Law located in Miami-Dade County, Florida.
a)No Expressed or Implied Warranties. Customer acknowledges that ESCAPE COMMUNICATIONS ENTERPRISE has made no express or implied warranties(whether oral or written), including those of merchantibility or fitness, for any particular purpose with respect to the Services contemplated by the Agreement and that all the Services provided by Escape Communication Enterprise are as is.
b)No Warrant Against interrupted operations of service. Specifically ESCAPE COMMUNICATIONS ENTERPRISE does not warrant against interruption of operations of service. Notwithstanding the forgoing, ESCAPE COMMUNICATIONS ENTERPRISE cannot be held responsible from performing its obligation when its services are delayed or hindered by war, riots, embargoes, strikes or actions or inactions of third parties(including interruption of phone services) and in the event of such performance is delayed by such occurence, ESCAPE COMMUNICATIONS ENTERPRISE shall have no liability to the customer.
c) The Service and System are available through your Equipment when it is within the operating range of your Wireless Service Provider or a Computer having an active connection to the Internet. The Service is subject to transmission limitation or interruption. You acknowledge and agree that we are not responsible for performance degradation and delays due to conditions on the Internet or due to the Equipment, your Computer or actions of the Content or Technology Providers. You acknowledge that ESCAPE COMMUNICATIONS ENTERPRISE, Content and Technology Providers shall not be liable to you if the Service in a given location is not available. If the Service is not available within your intended location, you agree that your sole remedy shall be to terminate this Agreement.
Customer agrees not to use the Service as its sole means of action regarding events that require action by Customer in order to avoid the following outcomes including and not limited to death, medical complications, loss of capital, loss of bussiness venture.
ESCAPE COMMUNICATIONS ENTERPRISE and its parent companies, subsidiaries and affiliates, including their directors, officers and employees (collectively, "ESCAPE COMMUNICATIONS ENTERPRISE Companies") shall not be liable for any loss, injury, claim, liability or damage of any kind resulting in any way from (i) your use of the Service, (ii) access to the System (iii) your use of any Equipment or Computer in connection with the Service or for Equipment or Computer failure or modification, (iv) the content of Information or other materials included with or accessed via use of the Service, (v) the failure to deliver any E-mail notification(s) or the delivery of E-mail notification(s) at times different that the times that you have designated, (vi) any acts or omissions of any Content or Technology Providers, (vii) for system failure or modification, or (viii) any "force majeure" (i.e., any flood, extraordinary weather conditions, earthquake or other act of god, fire, war, insurrection, riot, labor dispute, accident, action of government, communications or power failure, or equipment or software malfunction) or any other cause beyond the reasonable control of ESCAPE COMMUNICATIONS ENTERPRISE or its Content or Technology Providers. ESCAPE COMMUNICATIONS ENTERPRISE COMPANIES OR THE CONTENT OR TECHNOLOGY PROVIDERS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, RESULTING FROM THE USE OR THE INABILITY TO USE THE SERVICE OR SYSTEM, OR FOR COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES OR RESULTING FROM ANY MESSAGES RECEIVED (OR NOT RECEIVED) THROUGH THE SERVICE, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLE, EVEN IF ESCAPE COMMUNICATIONS ENTERPRISE AND/OR ITS CONTENT OR TECHNOLOGY PROVIDERS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
Unless otherwise specified, the SCOPE ADVERTISING & PUBLISHING Web Sites are for your personal and noncommercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from the SCOPE ADVERTISING & PUBLISHING Web Sites. You may display and, subject to any expressly stated restrictions or limitations relating to specific material, electronically copy, download and print hard copy portions of the material from the different areas of the Site solely for your own noncommercial use, or to place an order with ESCAPE COMMUNICATIONS ENTERPRISE or to purchase ESCAPE COMMUNICATIONS ENTERPRISE products. Any other use of materials on this Site, including but not limited to the modification, reproduction, distribution, republication, display or transmission of the content of this Site, without prior written permission of Escape Communications Enterprise is strictly prohibited. Harassment in any manner or form on the Site or any of the ESCAPE COMMUNICATIONS ENTERPRISE Websites, including via e-mail and chat or by obscene or abusive language is strictly forbidden. Impersonation of others, including a ESCAPE COMMUNICATIONS ENTERPRISE employee, host, or representative or other members or visitors on the Site is prohibited. You may not upload to, distribute, or otherwise publish through the Site any content which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable, or which may constitute or encourage a criminal offense, violate the rights of any party or otherwise give rise to liability or violate any law. You may not upload commercial content on the Site or use the Site to solicit others to join or become members of any other commercial online service or other organization.
